I just lost my legal case against Don't Ask, Don't Tell

Tuesday, October 12th, 2010

Today I received a letter from the Navy informing me they threw out my legal challenge to the Don't Ask, Don't Tell policy. They didn't look at any of the evidence and dismissed my case because "it wasn't filed in a timely manner."

Hell, I didn't know I had any more legal options until SLDN.org told me about the appeals process. My case was filed the same day I found out about it. I think it would be in the interest of justice to waive the time limit requirement, but they obviously aren't interested in justice.

My next steps? SLDN is too busy fighting discharges still in progress, so they won't help me. I can't really blame them for that. I could file a case in federal court, but I haven't found a lawyer to represent me pro-bono. I definitely don't have the financial resources to fight the government in a long court battle.

If the policy is repealed, I am too old and too disabled to re-enlist. The current language of the repeal bill makes it so no one can sue them for being discharged, which isn't very fair.

My faith in our country and our justice system just completely evaporated. At least now I can finally tell my story....

Best regards,
