Breaking News: Gary's case is currently on the docket at the Board of Naval Records Correction (BCNR) where he has requested reinstatement and back pay due to a discharge that was illegal and unconstitutional. This board has the power to fix records to correct an injustice, but they do not have the power to repeal the Don't Ask, Don't Tell policy. If the board does not rule in Gary's favor, his next step is to federal court and, if necessary, will be appealed to the Supreme Court of the United States.
