Veterans and families - Survey on Pain and Malpractice info
Monday, June 22nd, 2009
Please help me spread this message to all veterans and their families:
Veterans and families - please complete survey at American Pain Foundation:
AmericanPainFoundation.org
There is an effort underway to raise awareness of proper pain management within the Veteran's Administration. By completing the survey, the American Pain Foundation has more accurate numbers on the magnitude of this issue.
Also, Veterans CAN SUE the VA for malpractice! As active duty, you are government property and have no legal recourse. Veterans CAN SUE but it is difficult to do without an experienced attorney. There is a two year statute of limitations, and if you follow the established "process" you may run out of time. The case has to be fought on two fronts because of Federal Tort. The rules of evidence and procedures are different for both paths, so seek the advice of a good attorney.
But I do have bad news: I spoke with the top attorneys in the country and they have such a backlog of wrongful death cases against the VA that they aren't accepting many malpractice cases.
Malpractice is not just making a medical error, it also can be the failure to properly diagnose a medical condition.
Hope this helps!
